Commercial and Company Law

Are you sceptical of off-the-peg products? So are we. Company law means bespoke tailoring.

Legislators have created a fixed upper limit on the types of company that can be formed (GmbH, AG, PartG, KG, oHG, GbR etc). However, this does not relieve lawyers of their duty to their client to take these legally permitted configurations and customise them. The foundations for the successful functioning of a company are to be found in the setting of personal and industry-specific goals on the one hand and in preliminary planning as regards tax law on the other. The conceptual anticipation of possible partner disputes is just as vital as expert succession planning for the death of a partner. Once this is in place, the company law ‘dress’ will fit.

One of our core competencies is in providing an interface between company law and insolvency law. Our many years of experience, gained from acting regularly for a leading insolvency administrator, put us in the position of being able to identify company crises at an early stage and working on behalf of our clients to avoid actions concerning liability on the part of partners or management.
